You agree to abide by the rules of the venue. You further agree to comply with all reasonable safety and other announcements or directions from Carnage organizers and venue employees regarding your attendance at Carnage. Carnage organizers and venue employees have the right to refuse entry to or eject from the event any person that behaving in a manner deemed unsociable; illegal; potentially dangerous; or in breach of these terms, conditions, and policies. Carnage organizers reserve the sole right to determine and decide which behaviors warrant refusal or ejection. If ejected or refused from Carnage for any reason, you are not entitled to a refund. RELEASE OF LIABILITY AND ASSUMPTION OF RISK
The individual named below (referred to as “Attendee” or “I”) desires to participate in the Carnage Gaming Convention (the “Event”) sponsored by NNEG, LLC, a Vermont Limited Liability Company (the “Company”). In consideration of being permitted by the Company to engage in the Event and in recognition of the Company’s reliance hereon, I agree to all the terms and conditions set forth in this agreement (this “Release“).
COVID Vaccines Strongly Encouraged. While COVID-19 vaccines are not required to participate in the Event, Attendee acknowledges and affirms that Company has encouraged all Attendees to obtain a COVID-19 vaccine in advance of attendance at the Event, so that they are fully vaccinated (14 days beyond the last dose required for the particular vaccine) prior to arrival at the convention venue(s).
Assumption of Risk and Release of Liability. Attendee assumes all risks and accepts sole responsibility for any injury (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that Attendee may experience or incur in connection with attending the Event. Attendee, including Attendee’s heirs, executors and assigns, hereby releases, covenants not to sue, discharges, and holds harmless Company, its employees members, officer,, agents, and representatives (“Released Parties”), of and from any such claims, including all liabilities, claims, actions, damages, costs, or expenses of any kind arising out of or relating thereto.
Specifically relating to the global COVID-19 pandemic, Attendee acknowledges the highly contagious nature of COVID-19 and voluntarily assumes the risk of exposure or infection by attending the Event, and that such exposure or infection may result in personal injury, illness, disability, and/or death to Attendee. Attendee understands that the risk of becoming exposed to or infected by COVID-19 at the Event may result from the actions, omissions, or negligence of others who may attend the event or their families, colleagues, or others with whom they may have contact. Accordingly, Attendee understands and agrees that this Release includes any claims based on the actions, omissions, or negligence of Company, its employees, members, officers, agents, and representatives, whether a COVID-19 infection occurs before, during, or after participation in the Event.
Indemnification. Attendee agrees to indemnify, defend, and hold harmless the Released Parties from and against any and all costs ,expenses, damages, claims, lawsuits, judgments, losses, and/or liabilities (including attorney fees) arising directly or indirectly from or related to any and all claims made by or against any of the Released Parties due to bodily injury, death, loss of use, monetary loss, or any other injury from or related to my participation in the Event, whether caused by the negligence of the Released Parties or otherwise specifically related to COVID-19.
Duty to Comply with Health and Safety Procedures. In addition to all other rules and regulations relating to the Attendee’s attendance at the Event, Attendee agrees to comply with all COVID-related procedures that may be implemented by Company and convention venue(s) and all requirements of State or local authorities in effect at the time of the Event, including, but not limited to: mask-wearing and social distancing requirements and restrictions on certain activities that carry higher COVID-related risk, in order to protect as much as possible the health and safety of all Event Attendees.
No Current Symptoms. I certify that I am not experiencing any of the following COVID-19 symptoms as outlined by the Center for Disease Control: shortness of breath or difficulty breathing, fever, chills, muscle pain, sore throat, loss of taste or smell. If I develop any of the aforementioned symptoms during the Event, I agree to cease participation immediately and notify representatives of Company. I certifies that neither I nor any member of my immediate family have been advised by health officials to self-quarantine.
CROWD RELEASE/NOTICE OF FILMING AND PHOTOGRAPHY
By entering a Carnage event, you are entering an area where photography, audio and video recording may occur.
Your entry and presence on the event premises constitutes your consent to be photographed, filmed, and/or otherwise recorded and to the release, publication, exhibition, or reproduction of any and all recorded media of your appearance, voice, and name for any purpose whatsoever in perpetuity in connection with Carnage and its initiatives, including, by way of example only, use on websites, in social media, news and advertising.
By entering the event premises, you waive and release any claims you may have related to the use of recorded media of you at the event, including, without limitation, any right to inspect or approve the photo, video or audio recording of you, any claims for invasion of privacy, violation of the right of publicity, defamation, and copyright infringement or for any fees for use of such record media.
You understand that all photography, filming and/or recording will be done in reliance on this consent. If you do not wish to be included in a photograph and/or video, please make the request directly to the Carnage staff taking the photo or video.
By signing below I acknowledge and represent that I have read the foregoing Release of Liability and Assumption of Risk, understand it and sign it voluntarily as my own free act and deed, including without limitation the Assumption of Risk and Release of Liability and Indemnification requirements contained in this document; I am sufficiently informed about the risks involved in attending the Event to decide whether to sign this document; no oral representations, statements, or inducements apart from the foregoing written agreement, have been made; I am at least eighteen (18) years of age and fully competent (or if not eighteen, a parent or legal guardian has reviewed this Release prior to signing below); and I execute this document for full, adequate, and complete consideration fully intending to be bound by the same. I agree that this Release shall be governed by and construed in accordance with Vermont law, and that if any of the provisions hereof are found to be unenforceable, the remainder shall be enforced as fully as possible and the unenforceable provision(s) shall be deemed modified to the limited extent required to permit enforcement of the Release as a whole.
